Access to Bits, Bytes and Pieces

• Upon payment for services, you accept this Agreement in order to access the server and the Internet as provided by Bits, Bytes and Pieces in accordance with this Agreement.
• You acknowledge and agree that "unlimited access" does not guarantee you will always be able to access Bits, Bytes and Pieces or the Internet, or that you will never be disconnected. You understand "Unlimited Access" means your Internet Access Service Fee is not based on amount of time used, but is based on a flat fee.
• There is no limit on the amount of hours used, or times that the server may be accessed but it is not intended to be a full time connection. Accounts requiring 8 hours or more of continuous Internet Connection may be converted to a Plus Account at the discretion of BBnP. If at any time your account shows no activity but you are still logged on, the staff of Bits, Bytes and Pieces may disconnect your dial up connection after a sufficient period of inactivity.
• Bits, Bytes and Pieces will not accept any application for services from persons under the age of 18.
• Because Bits, Bytes and Pieces allows use of this account on multiple systems, Internet Access fees apply even if your system is not operational.

Passwords

• BBnP requires a unique User Id and Password from you to log onto the server and gain access to the Internet. Bits, Bytes and Pieces will use its best efforts to provide you with the User Id and/or Password of your choice as long as the User Id and/or Password is not a duplication, offensive (In the judgement of BBnP) or an infringement on the copyright or proprietary rights of another.
• Bits, Bytes and Pieces reserves the right to suspend Internet Access to Bits, Bytes and Pieces or the Internet, without compensation, until such time as contact is made with you and a new User Id and/or Password is selected.
• It is the Customers responsibility to safeguard User Id and/or Password so as not to be used for unauthorized access to your account or unlawful actions on or related to the Internet. Authorized account access is granted only to the Customer subscribing to Bits, Bytes and Pieces Internet Services and Accounts that are paid current and in good standing. Bits, Bytes and Pieces assumes no liability for any actions of unauthorized users of your Customer Account.
• In the event the User Id and/or Password is compromised, it is the Customers responsibility to advise Bits, Bytes and Pieces promptly.
• Requests for information regarding verification of or changes to User Id and/or Password, in person via telephone, email or any other means of communication, are subject to be challenged as deemed necessary by the staff of Bits, Bytes and Pieces. Requests from minors for changes to an account or User Id and/or Password will not be honored.

Fees and Charges

• To begin service with Bits, Bytes and Pieces, the Account must be paid, in advance, the prorated access service fee determined by the start date of the account plus the next month (or quarterly, semi, annual) access service fee.
• Service fees for all accounts are due by the 1st day of each month.
• Payments may be made by Cash, Check, Visa, MasterCard, Discover or American Express.
• Accounts from which checks are returned for "Insufficient Funds" will be assessed $30.00 fee and account will be suspended until appropriate payment is made.
• Accounts not paid within 15 days of the account expiration dates will be charged a late fee (currently $10.00). Accounts not paid will be suspended until such time as payment and applicable reconnect fees have been received.
• Accounts in default are subject to current reconnection fees. (Currently $10.00). Payment of this fee plus payments in arrears must be paid before account is reactivated.
• Accounts not paid within 30 days of the account expiration date will be terminated for non-payment. To reactivate this account, past due fees plus prorated and next months access fees must be paid.
• SPAM by any means, inbound/outbound will not be tolerated. BBnP will employ all means to identify and prosecute any person/s using the network  to facilitate/conduct spamming activities. As the account holder you will be liable, financially and legally for any abusive conduct via your account, in addition to any penalties charged to BBnP, incurred by these actions.
• Use of the newsfeed and/or newsgroups through Bits, Bytes and Pieces is limited by a strict usage policy. Bits, Bytes and Pieces Internet Access accounts traced by log records to indicate any spamming activity will be cancelled and will be billed incurred service charges as assessed by (the newsfeed server) Earthlink, or current provider, in amounts up to but not limited to $1,000.00.
• Arrangements for cancellation must be made prior to the first day of the month. No refunds will be given for partial month usage whether you cancel your service or we cancel your service for cause. Your service fees are not prorated within the current month. ALL INTERNET SALES ARE FINAL. No refunds or credits issued.
• Internet Service fees are non-transferable.
• Accounts cancelled after the start of business on the first day of the month are responsible for a full month Service Fee.
• Prorated Internet Access fees, Trip Charges and/or Setup fees are non-refundable.
• Bits, Bytes and Pieces currently offers one first time Internet Configuration Service at no charge, (In-store only). After a successful Internet connection has been made, regular Configuration Service fees apply.  See BBnP associate for complete details.
• Accounts paid with credit cards must notify Bits, Bytes and Pieces of intent to terminate service, by the 25th of the month to avoid credit card charges being processed.
• No credit will be given for inaccessibility to the Internet due to Bits, Bytes and Pieces System outages, busy signals or customer systems inoperability or misconfiguration.

Web Pages

• Each dial-up account is allowed 2 MB of webspace to host a personal web page on the Bits, Bytes and Pieces servers. This site may not be used for commerce or business enterprise. Advertisement of and solicitation for business constitutes a business web page and will be billed accordingly. Use of this space is limited to pages not containing advertising of businesses, services or items for sale. This includes but is not limited to banners, photos, hit counters or text. Additional web space for pages containing the aforementioned material or for web sites larger than 2MB is available for a fee. See a sales representative for current rates.
• Pornography of any kind is not permissible on any web pages, personal or business, hosted on the Bits, Bytes and Pieces servers.
• Web pages containing profanity or otherwise unsuitable material will not be linked to the Bits, Bytes and Pieces website.
• Bits, Bytes and Pieces reserves the right to refuse space to sites not in compliance with these terms.
• Determination of the suitability of any site lies with Bits, Bytes and Pieces.

Customers Restrictions and Duties

• You may not redeliver or redistribute to third parties for commercial or common use any services or products provided by or available through Bits, Bytes and Pieces.
• Use of Bits, Bytes and Pieces for the direct purpose of sending harassing or broadcasting of SPAM e-mail will not be tolerated. See paragraph 3D. Customer accounts using Bits, Bytes and Pieces for such purpose will be immediately terminated without notice or refund.
• You agree to abide by the Terms and Conditions of Use, but you understand that it is your responsibility to review it periodically to note changes that may from time-to-time be amended.

Warranty

• Bits, Bytes and Pieces makes no warranty, express or implied, as to its access, services, connection, use of, or the accuracy or correctness of any information available on the Internet through Bits, Bytes and Pieces.
• Bits, Bytes and Pieces has no control of information, graphics or content contained in documents published on the Internet. It is the Customers responsibility to safeguard and limit minors access to the Internet using parental control software, supervision,or other appropriate measures, from exposure to inappropriate or offensive material.

Limitation of Liability

• In no event shall Bits, Bytes and Pieces be liable for any indirect, special or consequential damages or lost profits arising out of or related to this agreement, or correctness of the information available via the Internet through Bits, Bytes and Pieces.
• Stock Traders: It is your responsibility to secure alternate methods of stock trade in the event that you are unable to access the Internet via Bits, Bytes and Pieces.

Term

• This is a month to month service agreement, neither party is bound to a contractual period of service.
• No refunds are issued for paid accounts. When BBnP receives a notice for termination the account will be left active through the paid period of service.
• This Agreement shall be in effect until either party terminates the account, upon thirty- (30) days written or electronic notice. You are responsible for all current and delinquent charges through the effective date of termination. Bits, Bytes and Pieces reserves the right to immediately terminate without notice, this Service Agreement for failure to comply with the Terms and Conditions of use as stated here.
• Accounts terminated then renewed, whether terminated by the Customer or Bits, Bytes and Pieces are no longer eligible for any previous "specials" or "promotions" previously enrolled in. Accounts that are "renewed" will be considered a new account and Access Service Fees will be collected at the current rate.
• Bits, Bytes and Pieces reserves the right to terminate an account at any time.
• Accounts paid with credit cards must notify Bits, Bytes and Pieces of intent to terminate service, by the 25th of the month to avoid credit card charges being processed.

General

• Bits, Bytes and Pieces reserves the right to revise these Terms and Conditions of Use at any time and for any reason, without notice or obligation, to any of the information contained on this site, including but not limited to user pages, links, shortcuts, announcements, special offers, or other product or service features. By entering this site you acknowledge and agree that you shall be bound by any such revisions. We suggest periodically visiting this page to review these terms and conditions.
• Email accounts hosted on the BBnP server will be limited to 20MB of stored data. Messages remaining on the server longer than 180 days will automatically be deleted from the server with no notice to the account holder.
